1. Agreement to Terms

By creating an account on barter.cafe (“Platform”, “we”, “us”, “our”) or by accessing or using any part of the Platform, you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to all of these Terms in full, you must immediately stop using the Platform. These Terms constitute a legally binding agreement between you and barter.cafe.

We reserve the right to update these Terms at any time. Changes take effect upon posting with a revised effective date. Continued use of the Platform after changes are posted constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use barter.cafe. By registering, you represent and warrant that you are 18 or older and legally capable of entering into binding contracts.

If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

Persons previously removed or suspended from the Platform may not register new accounts without express written consent.

3. Account Registration and Security

You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately of any unauthorized access or suspected breach at support@barter.cafe.

You may not share, sell, transfer, or assign your account to any other person. One account per person is permitted unless you operate a registered business account.

4. Listing Requirements

All listings must be accurate, honest, and complete. You must own or have the legal right to trade any item or service you list. Misrepresenting an item's condition, value, ownership, or availability is prohibited.

Prohibited items and services include, but are not limited to:

  • Illegal goods, controlled substances, or drug paraphernalia
  • Stolen property or items obtained through fraud
  • Firearms, ammunition, or weapons in violation of applicable law
  • Counterfeit, pirated, or trademark-infringing goods
  • Hazardous materials, explosives, or regulated chemicals
  • Human body parts, organs, or biological material
  • Sexual content or adult services
  • Services designed to harm, defraud, or harass others
  • Items subject to trade sanctions or export controls
  • Any item or service whose trade is prohibited under applicable law

We reserve the right to remove any listing at our discretion without prior notice.

5. Trade Proposals

Sending a trade proposal signals genuine intent to exchange. You must have honest intent to complete the proposed trade at the time of submission.

Acceptance of a proposal is a commitment to complete the exchange in good faith. Once a proposal is accepted, both parties are expected to coordinate delivery, pickup, or transfer in a timely manner.

barter.cafe facilitates the proposal workflow but is not a party to any trade and does not guarantee that any trade will be completed.

6. Completion of Trades

Users are solely responsible for verifying the identity of trading partners, the condition and authenticity of items, and all logistics of completing a trade.

For in-person trades: meet in safe, public locations; do not share home addresses with strangers; consider bringing a friend.

For digital or remote trades: use traceable transfer methods; confirm receipt before marking the trade complete; retain records of the exchange.

barter.cafe has no obligation to resolve disputes arising from trades that go wrong. See Section 11 (Dispute Resolution).

7. Prohibited Conduct

You agree NOT to:

  • Post false, misleading, or deceptive content
  • Harass, threaten, impersonate, or abuse any user
  • Send spam, unsolicited commercial messages, or phishing attempts
  • Circumvent, disable, or interfere with Platform security features
  • Scrape, crawl, or use automated means to extract Platform data without permission
  • Create fake accounts or manipulate ratings/reviews
  • Use the Platform to launder money or facilitate any financial crime
  • Violate any applicable local, state, national, or international law or regulation

Violations may result in immediate suspension or permanent ban, referral to law enforcement, and civil liability.

8. User Content License

By submitting listings, photos, descriptions, messages, or other content (“User Content”) to the Platform, you grant barter.cafe a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.

You retain ownership of your User Content. You represent and warrant that your User Content does not infringe the rights of any third party, including intellectual property rights and rights of privacy or publicity.

We may remove User Content at any time that violates these Terms or that we deem harmful to the Platform or its users.

9. Intellectual Property

All Platform software, design, trademarks, logos, and original content are the property of barter.cafe or its licensors and are protected by applicable intellectual property law.

You may not use our trademarks or branding without express written permission.

DMCA Notice: If you believe your copyrighted work has been used on the Platform without authorization, please send a written notice to dmca@barter.cafe identifying the copyrighted work, the infringing material, and your contact information. We will respond to valid DMCA takedown notices in accordance with applicable law.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your data as described in that policy.

11. Dispute Resolution

barter.cafe is a marketplace platform and is not a party to any trade between users. We do not mediate, arbitrate, or guarantee outcomes of disputes between users.

If you have a dispute with another user, you agree to attempt good-faith resolution directly with that user first. barter.cafe may, in its sole discretion, assist by preserving records or suspending involved accounts pending resolution, but has no obligation to do so.

ARBITRATION: Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform that cannot be resolved directly shall be submitted to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to participate in class action litigation or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate harm.

12. Disclaimers of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

We do not warrant that listings are accurate, that trades will be completed, that the Platform will be error-free, or that any user is who they claim to be.

Some jurisdictions do not allow exclusion of implied warranties; if you are in such a jurisdiction, these exclusions apply to the maximum extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARTER.CAFE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACCESS THE PLATFORM IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

14. Indemnification

You agree to indemnify, defend, and hold harmless barter.cafe and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent court proceedings are permitted under Section 11, you consent to personal jurisdiction in the state and federal courts located in Delaware.

16. Modifications to Terms

We may revise these Terms at any time. When we do, we will update the “Effective Date” at the top of this page. For material changes, we will provide reasonable notice via in-app notification or email.

Your continued use of the Platform after the effective date of any revision constitutes acceptance of the updated Terms.
